If you want your brother to have it then transfer title to his name and be done with it and any expense. If he fails it will be his fault and his problem. (but somehow I still think you would continue to support him.)

If you do want the home, and him to move out then just give him 30 days notice and then evict him.

PS rule #1 of renting is NEVER rent to someone you know.

Or you can just continue to be your brother's keeper. You need to decide what you really want.

I can't give it to him! The co-op has a rule, whoever signs the occupancy agreement must prove a credit score of 650 and show income of $2,300 a month consistent for 2 years. He can't do that! He keeps getting fired! This is the reason for that rule. People were turning it over to their kids who wouldn't pay the carrying charges and the coop would have the cost of foreclosure. I asked, trust me.

And no, you are dead wrong, I want nothing to do with him ever. I do not want to be my brother's keeper. I didn't rent to him. He has lived there since he was 4. He was living with my father up until my father died in 2006 and I became stuck in this position. I never wanted it. The day before my father died, he begged me not to turn it over into my brother's name because "he will lose it". He would have a long time ago, if I stupidly didn't want to save him!

Oh, and at a moments notice he can go back on disability, have food and cable money and me paying the rent.

    Then just sell it and move on with your life. You did enough already. Any money is better than your current situation.

    As I mentioned, go to your county courthouse and file an eviction is your first step. The contact a realtor and put it on the market.
