who can sign a lease - Landlord Forum thread 359916

who can sign a lease by Daniel (CA) on November 3, 2019 @23:46

I hired a property mgmt. co. and I didn't sign 2 leases, but one of the employees of the broker did.

Does the person signing need to be a licensed real estate agent or can an employee of a broker sign it? or should the broker with the license sign it?

California

First of all, learn the proper descriptions, rights, authorities and responsibilities of the people you are dealing with. All the titles you are using MAY apply to the same person but their authorities and responsibilities ARE NOT interchangeable and can vary by state and local laws.

Assume your tenant knows this.

Any judge you'll wind up in front of does.

GENERALLY,......unless you as the LL specifically authorize, IN WRITING another person or company entity to sign on your behalf, they cannot sign for you.

Read the contract, agreement or piece of paper you signed with the
''' management '''' company. You may have authorized them or their employees to sign on your behalf.

I believe in CA legitimate property managers or management companies must be licensed real estate brokers. Brokers, realtors and sales persons are not interchangeable terms / titles. Neither are the titles pertaining to property management with each other or those other titles.

Any.person or entity can authorize any other person or entity to act on their behalf by giving them a written power of attorney.
