YOU cannot do anything at this point. SHE needs to take that police report,show it to a judge, and get a restraining order against that person, for at least a year. Yes, you need her written permission to change locks.
Yes, the person "needs" to be evicted, but you cannot do it without the help of your tenant. If SHE files for a restraining order, that could happen inside of a week to get the person out. An eviction could take a month or two, IF you do everything right.
Instead of your T moving out of state to her moms place, she needs to stay in a shelter for battered women for a week or two (in the town she's in now), and get that restraining order ASAP. She cannot do it if she's out of state. And if she doesn't pay you rent in March, tell her you may have to evict HER for non payment of rent.
I realize she's scared, but the people in a shelter will help her out greatly. That's what they are for-----to help out people like her, get back on their feet again. They help out dozens, if not hundreds of people just like her, every year, in hundreds of towns through out this country.

Thanks Garry! What kind of law is this? The guy is not on the lease and we can't just change the locks on him? Is this squatting rights related?

Welcome to CA. Even someone that breaks into an apartment and lives there is a tenant. You must follow legal procedure to get him out. Does you lease say the real tenant cannot have long term guests or anyone else living there? What grounds would you be able to evict him by? All he has to do is say he contributed $1 to the rent and you cant touch him. Be careful of illegal lockout will get you in even more trouble.
Restraining order is the quickest way out. You should consult with your courthouse or an attorney to make sure you do this correctly.

Garry What about thinking of this man as a person who is not on the rental agreement first. Then approach him as a person who you serve with a 3 day notice to quit, and then to serve to evict after 3 days? I have dealt with this type of case quite differently. Just curious here.

Current plan of action is break the lease with her and remove her stuff. Once she is out, change locks.
