Welcome to CA. Even someone that breaks into an apartment and lives there is a tenant. You must follow legal procedure to get him out. Does you lease say the real tenant cannot have long term guests or anyone else living there? What grounds would you be able to evict him by? All he has to do is say he contributed $1 to the rent and you cant touch him. Be careful of illegal lockout will get you in even more trouble.

Restraining order is the quickest way out. You should consult with your courthouse or an attorney to make sure you do this correctly.

I don't think a break-in constitutes a tenancy.
