Florida:

I have a great tenant who wants her boyfriend to move in and would like him added to the lease. They plan on buying a home and moving out at the end of the year. I know he spends most of his time there anyway, so I agreed for an extra $150/month with an application and credit/background check. I now have two problems.

1. He didn't pass either (bad credit 500's, not enough income to pay rent on his own and minor background problems, i.e., recent DUI and no rental history) Bottom line, I would never rent to this guy, but he's sort of already there.

2. The current lease was for 6 and a half months, that expired last year and has reverted to a month to month. How do I add someone to this kind of a lease?

I thought I would do a very basic lease addendum and add him as an occupant to "existing" lease and not mention expiration dates. I do not want to write a new 6.5 month lease. That way if there's a problem, I can terminate the lease in 30 days. Question: Can I add him to an expired/reverted mtm lease?

Bottom line, vacancy is NOT a problem for me, it's just the time involved in getting a new tenant and I live out of town. I'd prefer not to terminate the lease agreement and let them move out at the end of the year. I seriously doubt I will have a problem with this guy. She's been dating him for a couple of years now.

The easiest thing for you to do, is make out a brand NEW lease with the new rent amount, and with both of their names on the lease. You can put a start date of April 1, and where it has an "end date", I always put down the words "month to month, 30 day notice by either party." All my leases are M2M starting from day 1, and I have 20 places I rent out.

If you already know he's been staying there off and on, and have not said something to your T about it, that means you have already accepted the BF, but do not have him on the lease yet. Get him on the lease, and collect $150 more in rent for the rest of the time they are there. Remember, they "plan" on buying a home. But if they try to use his credit to qualify, and get turned down, they may be tenants of yours for several more years. Sometimes "plans" don't always go as expected. And YOU get to rack in an extra $150/mo, with NO expense other than his background checks.
