I have one lease agreement with 3 unrelated individuals fora 3bed 2bath unit. When it comes to charging them for repairs and violation of non smoking policy, what's the best way to do it? One of them claims to be innocent and reports wrong doings of the other two for not keeping premises clean and smoking inside of the unit. It is a non smoking rental, and all 3 claimed they were not smokers on their application.
I feel they all are responsible regardless which one is the innocent since they share the space therefore they share responsibilities to follow the terms of the agreements. Unless I catch them in the act; otherwise, it is most likely they all claim to be innocent ones. How would you handle this case?

In the USA, "ALL persons are presumed innocent until proven guilty in a court of law." That's the quote running on every episode of the reality show, "Cops" Your situation is no different. You need VIDEO proof of someone smoking inside your unit. You also need video proof of any damages or unclean premises.

LET IT GO, SUNNY ! You cannot force a tenant to live how YOU WANT THEM TO LIVE. when they ALL move out, then you can charge their deposit for any damages and cleanup of the premises. If they have disagreements between themselves, tell them to work it out themselves, call the cops, or move. YOU should NOT be a referee between adults/tenants.
