bicycle and bookcase in common area hallway - Landlord Forum thread 360514

bicycle and bookcase in common area hallway by Daniel (CA) on May 23, 2020 @18:23

what am i supposed to do if the tenant will not remove the bicycle and bookcase from the hallway? this is an 8 unit building.
i am getting conflicting information from the lawyer

the main lawyer supports my actions of removing it because it is a safety hazard.
the legal aid from the same lawyer says to leave it over the weekend because of a claim of loss of use if I remove the items.. the lease says it will be removed and tenant charged a storage fees

What does the fire department say about blocking a hallway?

If you lease says not to leave anything in hallway, give him a 3 day notice to quit or cure. If he leaves it then remove it. (you should probably store it somewhere else in case some insane judge rules against you later. At least then you can ask for storage fees -(see your state law on abandoned property.
