Yes, all persons, age 18 or older, should fill out an application for all landlords. Those same people (In your case,the nephew), should also sign your lease, even though they will not be living there very long. The more adults that sign a lease, the more protection you as a LL have, if some loses their job.

Hi Garry. The nephew is in college and actually does not have income. The main two people who will sign the CA lease are husband and wife (who has the nephew), so basically we can treat the nephew as a short term guest (summer time)? The nephew will not sign the lease and if the husband and wife are no longer rent the house for any reason, then as a landlord, I don't have any responsibility to keep the nephew be on my house. If I have the nephew to fill out the application, it is just for the record because he is older than 18 yr. old, but he is not the person paying me any rent. Thanks for your good inputs!

    I think you are making a big mistake, but you do as you wish. MOST LLs feel the more people signing a lease, the better. If rent doesn't get paid, or there are damages to your place, the more people LEGALLY responsible for the rent or damages, the better. If you ever have to go to court to evict anyone, you will find it much harder to evict the nephew, because you have NO lease with him.

    Why not treat this situation as a learning experience for the nephew. He needs to learn that turning 18, and becoming an adult, brings legal responsibilities with it. What happens if the husband and wife are gone for 2 weeks this summer, and the nephew decides to have a couple of weekend parties, with maybe alcohol and MJ there? Teach the kid responsibilities------put him on the lease!
