Hi,
Location: San Diego, CA.
Current lease is expiring by June end. I would like to start showing house to prospective tenants. There are some seriously interested parties, but not ready to apply until they see the house. But current tenant is not allowing showing due to Covid concern. I assured them that we will limit showing to only serious applicant, will provide them mask and hand gloves. They wont touch door knobs etc. Will take temperature before entering. But still tenant refuses. What are my option? Can I deduct rental loss from security deposit? Rent is pretty good (4.2k)
Hence I dont want to leave house vacant even for a week. (it never has been so far)
Any advise is sincerely appreciated.

does your lease specify anything about showings?

Give 24hr written notice and then get a police standby to be there when you go in.

You have 2 options here. Either go to court to ask a judge to grant you access to your property, or WAIT till the tenant has moved out. YES, it's pretty much in every lease across this country, that a tenant must grant a LL access to show a property. BUT, all tenants across the country ALSO can deny the LL access if they want to, and force the LL to gain that access thru a court system.

WE ARE IN DIFFERENT TIMES,HERE, WITH COVID 19. YES, you are saying to the T all kinds of things that could/should protect them from the virus. But if they STILL feel unsafe in their own home, they have the right to deny you access.

Your BEST bet is to quit asking for access, and wait till the T has moved out. Has the T paid rent for June? If they haven't, if you get them mad at you, they could withhold rent from you. OR they could leave you with a bunch of cleanup and damages when they leave. This is the time you should be treating all tenants with dignity and respect, and not thinking about whether you can have it rented again by the first day they move out.

It is unreasonable and potentially deadly to show apartment now. Take this disease seriously. I wouldn't let you in to show the apartment if I were your tenant.
