My 32 year old niece has been sponging off my mom for well over 10 years now. She recently moved in with my mom (Jan. 2020) and has not paid any rent whatsoever. She is verbally, mentally and psychologically abusive to my mom who is 85 and in poor health. Last night was the final straw for my mom as my niece went into a screaming tirade. My mom walked away, went into her bedroom and closed the door only to have my niece follow her, stand outside and scream at the top of lungs putting my mom down. Mom wants her gone. As far as I can decipher, she is a non—paying guest at the most. I’ve read in the Florida Statutes that she could be charged with trespassing, but you and I know most cops will shrug their shoulders and tell us it’s a civil action. What can I do?

But just be aware,....that sword is double edged and cuts ALL ways.
The neice OR mom could be the one removed.
Once the authorities are involved, you're in the ring also.

Pretty sure niece is a tenant by now. Evict her, but on this one you need to get an attorney.

While at attorney get power of attorney for you to take care of your mom. Talk with attn about how you could control mom's $ so niece cant get it anymore.

Here in California with Rent Control, this is what I saw in court. It may give you an idea.

a nephew refused to leave and claimed tenant protections.
the LL lawyer proved that the nephew was a border and not a tenant. Therefore, the nephew didn't have tenant rights.

The nephew was a border because he did not have a specific room that was exclusively his. He slept in different rooms.

With the federal Eviction moratorium you might not get far if you go the tenancy path.
I would change the locks when the niece is out and let the deadbeat fight it from the outside.
...unless she has any official mail. cell/utility/insurance
...unless her DL is the address.
...unless she was given a bedroom and can identify the objects inside the bedroom as her own.
...an attorney is highly advisable.

with COVID your mom can certainly claim the Niece isn't a tenant because of how people were reacting to the lockdown.

Finally, you need to watch at least 5 different Judge Judy LL/Tenant cases to see the tolerance/temperature of how similar situations are addressed.
