How long of a lease did you sign with her------1 year ?, 6 months ?, M2M ? If she is on a M2M, give her a minimum 30 day notice to be out by either Sept 15, or by Oct. 1 (depending on how your state law is worded) . The things you mentioned that she broke, are not health or safety items.

Tell her you will not be repairing them until she moves out. The same goes for any other items she breaks. She can repair the items on her own dime if she wishes, or she can give you cash up front to repair things. And if you smell marijuana in the hallway again, you will again spray something to cover the MJ smell up.

I am in NJ. She broke everything, and blame me on not fixing it. What is the legal grant if I claim that I will not be repairing them until she moves out? She already reported to City and saying that I shut off AC which is absolutely made up.

She already got evicted by the court due to non-payment back on Feb before covid-19. Right before the lockout was supposed to carry out, the Governor issued the Executive Order and stopped the lockout. Now, he is saying that he got COVID-19 without any proof.

    Vincent, your best bet is to just STOP COMMUNICATING with your tenants, PERIOD! NO MORE phone calls, emails, texts, mailing letters, etc. DO NOT ANSWER ANY of their communications to you. HOWEVER, if they say one of them has COVID-19, have them send you something back in writing that says they have it. IF they do have COVID-19, that works in YOUR favor. NOW you can say that you, nor anyone else can go to fix anything, because you may contract the virus, and give it to other family members.

    You do NOT need to put yourself in danger, just to fix things the T broke. Besides, it's only health and safety items that the city inspectors would say you would need to repair. And once the city inspectors know the WHOLE story, THEY may tell the T to get, too.

    Yes, you are going to lose a bunch of money, but all you can do now, is wait for the eviction process to start again.
