can payment be used as an admission of guilt?
I would have tenant sign a release and indemnity of the situation.
or you could submit a settlement agreement which states the facts and conclusion of LL not being at fault. But offers 1/2 the cost. and the agreement is accepted if the money is accepted/deposited/cashed...
