i know that, but what do I tell the tenant without stating the obvious?
(it is sort of like when people rationalize somehow that it isnt considered stealing from the janitors closet...)
This is what I referred to in my notice to the tenant.
Page 2 Paragraph 7 of your lease states "Use of Premises" "Use of Premises: Tenant shall not violate any law rule or regulation while on the property nor in the use of the premises , nor permit waste or nuisance not interfere with anyone's peaceful use of the property or surrounding property."
You had no authorization or permission and your lease specifically prohibits the conduct and actions referred to in your email. You admitted to taking paint. I don't know why you think it was ok to take the paint. Do not enter the storage closet and do not take any items from the storage closet.

this is one of the problems when we use form leases in boilerplate lawyer language, intended to be as broad as possible.
Plain english tends to work better. Tenants are not lawyers.
1. lock the storage cabinet. 2. post a sign::""landlord / management storage only - no tenant access.
if this is the worst problem with this tenant consider yourself lucky. Don't get me wrong,.....i'm not minimizing their stealing your paint,.....just tell your tenant they were wrong, dont do it again and get on with running your business.
