There are tens of thousands of LLs in the same boat as you. I am one of them. I have 1 T who hasn't paid since Sept. too. And it's only going to get worse for us LLs. Pres. Biden is probably going to extend the national eviction moratorium for another 6 months. For now, forget about going to court for nonpayment of rent.

What state are you in? How long is your lease? Can you possibly give them a 30 or 60 day notice to move? If you can, give them notice to move, BUT----don't say anything about non payment of rent as the reason why you want them to move. Figure out another reason why you want them to move. You still may end up in court, but it will be for them being a "holdover" tenant. You should remind the T that the moratorium just says you cannot EVICT them. But it also says the rent is not "forgiven"------when the moratorium is lifted, they will need to come up with ALL of the back rent, or THEN they can be evicted.

    I do not need to see your lease, but YOU need to know what ALL of it says. AND you need to completely know your LL/T laws, along with your eviction laws for AZ. If you are not too familiar with your laws, you probably need to hire an attorney who is. When does your lease end? Next time, only give out M2M leases like I do.
