Dear Tenant

Item 1

Thank youfor your email of January 23, 2021. I appreciate your cooperation and the fact that you will comply with all my requests. Of course if you are entitled to a rent decrease from the rent control board, you will get one. However, I never gave you permission to put any pots or other items in the common area or anything on rafters in garage. If you would like to remind me of when or where, I would be glad to try and remember.

I am sure you have heard about spontaneous combustion. We don’t want a fire to start anywhere on our property.

Once you remove all your property from common area and garage rafters, you will be done. If there is anything left I will have it removed, either in common area or in the garage. Remember, it is not your place to tell me what the code is or is not. It is clear that your plants are blocking access to the railings on stairs, that they are ruining the decking and walkways, and must be removed. Your remedy (as you have stated) is to file a decrease petition with the rent board. I will be happy to cooperate with your petition so that these issues can be resolved.

If you need help or more time moving anything let me know and I will have someone there to move it for you. However, please do move everything you can. If you labeled what was yours then there would be less confusion.

I am sorry to hear that you feel that you are being singled out; however, nothing can be further from the truth.

Item 2

one last thing. If the north side of the property is an emergency egress path and nothing can be there then you are storing your own trash cans in the path of travel. And there is a tree in the way.

Landlord response:-

Thank you for your question. Please let me know if you would like me to store the trash cans where the city prefers me to; which is outside the laundry room windows? Putting them where they are now was a reasonable alternative; if not for a minefield of pots and plants. Do you think putting the trash cans opposite the mailbox a reasonable alternative or maybe on the grass?

Item 3

I tried to explain to you on site the other day that the items you note in your letter are not all mine. This is when you accused me of harassing you even though I was trying to let you know what is mine vs other tenants.

one more thing. During Covid we need this outdoor space more than ever. Tenants take turns using the space since it is the only outdoor space we have. We have been trying to make the concrete jungle that you have given us look nice since the bit of yard is full of junk.

Landlord response:-

I was concerned because you approached my group without wearing a mask; maybe you forgot that I had diabetes? Please wear a mask while outdoors at the apartment building. Please comply with the laws and safety measures.

Outdoor and common area spaces are closed as per COVID rules. Do you realize that you put yourself and others in danger by your statement? The only legitimate use of the back area is for essential services... Laundry... not exercising... Gyms were closed too. Going in and out is ok but lingering or loitering is not.

Finally,

Please remove the water diverter on your kitchen faucet and return the aerator as soon as possible; and let me know so I can inspect. That was the problem, every time I sent Gary to check out your issue ever since you moved in.

Your recent emails seemed unfair to me, but I must encourage you to overlook the confining COVID changes and work together by first not encroaching on others. I am open to your suggestions, but the communication lines seem to be hindered by COVID impacts. When some people say that "Landlord don't care about people", it is a stereotype that ignores the fact that most Landlords are providing the most precious and valuable gift second to life- a home and a place to live. & Living in the Best city in the world, which 99% of the world is overlooked on top of it.
