Just wanted to update you on what has happened.

I forwarded CITY CODES, and my lawyer's messages to the Housing investigator, stating that owner has the legal rights to enter, and there is no legal ground for T. not allow me to enter. Finally, the investigator asked me to check with Housing legal team which confirmed the same as well.

The investigator didn't response on my question if I should go for the appointment because even I go there T. won't allow me to enter anyway. After I think over, I eventually went there.

The T didn't show up in the property at all. Only daughter there and he allowed us to get in the living room. But, the bedroom the entrance the to the attic furnace was locked up. We cannot do anything with the furnace.

After that, T lied about it by saying he was there until 10:15. That was a bluntly lie. we got there 9:14am, during this time, nobody saw him at all. He lied about a lot of other things as well.

Since then, I have not heard anything from the investigator. I told him what has happened.

I don't know what should I do next, if all the sudden the investigator would give me a ticket?

Also when we were inside, the temperature was very warm, the heat seems working!

You do NOTHING now. You got inside----the heat was on/working----you left. NOW, follow thru with your eviction process and get the T out. There is NO reason for you to get inside again until the T is gone, and you have possession back. Whatever damage you would find inside now, will still be there for you to repair once the T has left. As far as your LEGAL right to enter your property, YES, landlords all over the country have the "legal" right to enter their own property, if they have given the proper/legal notices to the T. BUT----your "legal rights" are WORTHLESS, unless they are enforced by a JUDGE. Landlords, and sometimes even housing inspectors, have to get a court order from a judge, to be able to get inside a place, if a T will not let them in. Heck, even the police sometimes need to get a WARRANT from a JUDGE, to be able search a place inside. You are no different. Unless a housing inspector get ahold of you, forget about the T, except in following thru with the eviction process.

The supreme court just ruled that federal eviction moratoriums are unconstitutional. Maybe that can help you. Sounds like NJ laws are different,here in Colo if no heat after x days the landlord has to put tenant up in a hotel. Just give 24hr notices and have police come every time you need to enter. It's horrible that scum tenants are abusing they system.In anticipation of eviction you should verify where they work and what they own to garnish later. Make sure you get their new address when they do move so you can serve them papers.
