Here is the latest on with regards heating in my rental apartment.

After 2nd attempt under City Housing coordination, once again, the tenant refused me to enter. As the result, Housing decided to close out the case, meaning no longer accept the tenant's complaint about heating.

My question is: How can I ask for vacating the house due to no heat, and therefore doesn't meet the living condition?

It should be up to City to proceed with the process, but by knowing no heat, they didn't do anything about vacating. Should I just let go, or push them to vacate?


Here is the background:
The tenant has not paid for 18 months now, and already got evicted, only due to pandemic, the lockout got frozen. So, I would very much to vacate the apartment by the city.

Forget about the no-heat, and the city. The case is closed, at least from the city's standpoint. You need to check with an attorney, about the eviction/lockout, and where it stands now. The eviction moratorium is due to end on March 31, and I have not heard that it was going to be extended. That's probably because the Stimulus money going out now, can pay for back rent, plus, more and more people are getting shots, and the economy is starting to open up again. Your eviction paperwork you already have, may be enough to get the T out in early April.

Can you shut off the gas/ hot water?

That should get tenant to cooperate...

now now, i dont mean that you should do a "self help eviction"

but since there is a safety concern of the heating of the place, it raises safety concerns that fall upon the LL as liability.

so ask the court ( ex parte motion ) to shut off the heating supply at the source until repairs are done.

at this point the tenant is suspicious of every activity from LL so they are disregarding the seriousness of the risk. co2 fire.

I would get a local pastor nun etc to possibly mediate the issue so you could make it clear that you want to repair the problem and nothing else.

for their safety.
