The landlord can apply. Find your state agency that handles it and talk to them.

Correct, but it needs the tenant signed which he would not do.

So, what should I say to him to ask him to sign, and if he doesn't, then it will leave a record?

After all is said and done you still need the tenants information. If they are unwilling to provide this information you are stilled screwed. I am also going through this now. Tenants have all the rights. Landlords have none.
