T. not paid for 20 months all the sudden moved out - Landlord Forum thread 361338

T. not paid for 20 months all the sudden moved out by ownernj on June 20, 2021 @10:17

My tenants has not paid for 20 months, she already evicted by the court in March, 2020. She is taking advantage of pandemic and didn't locked out, stay there until yesterday. Based on my camera, and downstairs tenants, she very likely moved out yesterday. She didn't tell me anything, and didn't give me keys.

So, my questions:
1. Should I text her and ask he if she voluntarily moved out? I am sure she won't give me the answer, but should I ask anyway?

2. I probably still couldn't change the lock, based on my understanding. But, should I call cops, and ask for going inside to check it out?

Thank you!

No need for you to call the cops, or call or text or email your tenants. Simply post a 24 hour notice on her door that you will be entering her apartment to see if she has moved out. The notice should say :

Dear tenant (her name) : Recent information has come to my attention that you may have moved out (vacated) your apartment at (address) in the past few days. This is my minimum 24 hour notice to you, that I will be entering your apartment on (date and time) to confirm that information. (then sign your name)

Make 2 copies of your letter, and post 1 on her door. Then take a pic of it on the door. Go over the next day, and take a witness and a camera with you. If she comes to the door, ask to go in. if she refuses, leave----she is still there.

If no answer, use your key to go in. Go thru the place, to determine if she has moved. Look for the amount of food in the referige and cupboards. Check closets for clothes, and toiletries in the bathroom. See what furniture is still there or is missing. You and your witness will have to make a determination as to if you think she has left,or is still living there. Take pics BEFORE you move anything of hers.

If you determine she is gone, CHANGE THE LOCKS ! You now have possession back. Then do whatever you need to do to get it ready to re-rent again.

Check your state statutes. In Colorado they roughly define a move out if substantial furnishings have been removed.

The rats fleeing a sinking ship. They stole everything they could from you and are now gone because the eviction moratorium is lifted.

Be sure to file a credit report against them!!!! You can do so on this site.
