Yes, and that means you will be making out a NEW 3 day notice for OCTOBER'S rent. Do not put down ANY amount for Sept. rent OR any late fees. Iowa laws expect a landlord to do things in a timely manor. If a LL allows a T to stay all month without starting an eviction procedure, then the LL loses the right to evict for that particular month. It's called " 30 days peaceable possession ".
That's why all LLs in Iowa should be mailing their 3 day notices by the 10th to 15th on the month, in order to give themselves time to file in court, before the end of the month. I've seen judges look at a calendar and count the days from when you mailed your notices. 1 day off, and you get to start all over again.

Probably, but you should wait til the tenant is completely out, then total up your losses against their deposit. Whatever you come up with, that is the figure to use for your money judgment. You have at least a year from after you get possession back, to file for the money judgement.
