I am in the middle of a one year lease with some tenants who have become unbearable to work with. Eviction isn't an option as they are not in breach of contract, but I really don't have any desire to renew the lease as they are so high maintenance and have been verbally abusive to my property manager, as well as threatening legal action at every turn.
My question is this: when renewal time comes around can I offer for them to renew at a much higher (50% higher) rental rate in order to get them to leave, and then advertise the unit to others at a lower rate? Or will this open me up to legal consequences? I'm also concerned that simply not renewing with them may open up legal troubles as well, given their behavior thus far.

You are correct. You could be opening yourself up to legal consequences if you up their rent by 50% to get them out, and then when they move, offer new tenants a lower rate. Since they are threatening legal action against you sometimes, why not 1-up them. Hire your own attorney now, to send them a non-renewal of lease notice, at about 45 days before the end of their lease. That will show them that you are not only giving them legal notice to move, but it also shows them you already have your own attorney in case they don't move.

We're in the business of allowing people to live in properties we own, in exchange for them giving us money and taking reasonable care of our property.

Over the years everyone in every business has business dealings ,...going both ways,.....with people they may or may not have fondness for.

In the current environment, good stable qualified tenants ain't so easy to come by.

The devil you know may be better than the devil you don't.

In other words, if your jurisdiction allows you to simply nonrenewal without a reason then take it even if it makes you feel like a jerk..

this is an important point/ concept for new LL's to understand:

it is far better legally to non-renew with no reason than it is to non-renew with a reason; if your jurisdiction allows it.

1 your reason may not be reasonable to someone else- the judge.
2 no reason may make you feel like a jerk; but if the law supports it, then you dont have to justify your non-renewal.
3 if you nonrenew based on a reason then you open yourself to have to justify the reason if you are questioned about it

You pay the property manager for the pain in the neck tenant matters. Have mgr notify tenants of non-renewal if one-year lease when the time gets closer. Ask mgr about your state law details.
