Security deposit - Landlord Forum thread 362094

Tenant is disputing amount taken off deposit.
One of the rooms smelled so badly (teenager) that it needed repainting.
Is odor considered wear and tear here or not? I don't want to waste time/money in court so should I refund painting fee here?

“Normal Wear and Tear” is a normal deterioration or wear based on natural causes use without regard to negligence, abuse or carelessness by the tenant or their guests during the time of possession.

Odor ??

What does it smell like. .?

How long did they live there ?

Usually leaves along with the tenant.
Air the place out
Clean carpets and drapes
Heavy smokers will remain in The paint requiring one or two coats of kilz then repaint.

I would also strongly recommend checking for deal animals

You must be expected to paint anyway.
But extra coats of Primer to cover such things would be beyond normal wear and tear w&t... ie stains on wall from skid marks and body fluids is not normal w&t ... Body odor is normal w&t: your report should go as far to indicate the absurdity of the expected source of the odor…. It smells like the room was used instead of the toilet and there was piles of tissue paper found in the corner next to discolored splatter of unknown substance.
i once had cat urine odor which took me 3 weeks of sanitizer process to get rid of. you will need receipts of the extra work and material that was required.
