I am in CA. I have a good tenant who lived in my house for 7 years. This year, she left the house and passed the security deposit to her daughter and her daughter signed 1 year lease with me. Her daughter find a roommate. I signed lease agreement ( 1 year ) with both daughter and roommates. So far so good. After 4 months, the roommates suddenly contacted me asking walkthrough list, repair of mold issue, pest control. During the conversion about repairing, I noticed the roommate didn't pay rent. It is 17 days overdue. The roommate gives some reason that out of her control why she can not pay rent. I contacted the daughter. The daughter doesn't want this roommate and willing to cover full rent if I can evict her roommate as her roommate doesn't respect her and her kids, hosting parties very late blah. I don't have this roommate also. So last week I issued 3 days letter to evict her ( I have to put both daughter and roommate's name in the eviction document, do I? ). The roommate contacted me and ask do not evict if she can pay. I just said , please pay your rent or else the eviction process will take into effect. Now the daughter has paid full rent include her roommates and asking me to evict her roommate because this is her only chance to get rid of her. Today is the 5th date after the 3 days letter issued. The roommate sent me message today asking if she pay rent today, will everything stay good? I asked the daughter, she doesn't want this roommate. Honestly, same for me. I am wondering if still ok to proceed with eviction process if the tenant willing to pay after 3 days passed? Also is it ok to elicit tenant partially? I unfortunate involved into roommates disputation. The daughter and family has been my good tenants for many years. I want to help her. Any suggestion? Thanks a lot!

Good luck Tough state for landlords in general
If both names are on lease, you must evict both FOR CAUSE if during lease term
If m2m you can try terminating with MERELY proper notice IF YOU ARE NOT RENT CONTROL OR STABILIZED.

Have the police gotten involved in roommate disputes ?


Most judges WILL NOT evict paying, current tenants
Stay out of roommate drama
If m2m and you are not controlled or stabilized you can raise rent

Your tenant can offer her roommate cash to leave.

If party's are loud police can be called by neighbors as disturbance .
Multiple times responding with reports might get you somewhere with court

Be careful about after the fact retaliation or harassment or discrimination claim by bad girl roommate.

If it were me in your shoes, I'd stay way out of it. Be a good professional LL to BOTH, EQUALLY

not your problem till THEY become your problem.
