To Renew the Lease or to Not Renew...


Lease expiration time should be seen as an opportunity for an upgrade, whether you keep the existing tenant or opt for a better one.

I once said, "You think you know someone? You don't really know them until they've rented from you."
There are many aspects of a rental property or tenancy that you can upgrade.

  • Upgrade in Tenant(s)
    The Notice of Lease Non-Renewal
    is a type of lease termination notice for a soon expiring lease you want to end with your current tenants. Most tenants expect to re-new the lease or stay on a "month to month" after the original lease expires, but this form tells them in a friendly yet business-like way to leave while not being harsh or too intimidating.

    Often we become "stuck" with tenants who may have started out alright, but start to go down hill after a while. We usually feel trapped into keeping them because it is just easier to put up with their annoyances than to replace them with a better tenant.
    You should not feel obligated to extend a lease and hold on to tenants who are not living up to their responsibilities or who are making your life more difficult than it has to be. The Notice of Lease Non-Renewal should be legally served to the tenant, mailed certified and regular mail.

Free Lease Renewal Notice!
A Notice to Renew and a Notice to Vacate lets your tenants know they are welcome to renew... or to leave.

The Notice to Renew or Vacate is a combination form which can be used as a lease renewal form or a tenant's notice to vacate. The form provides for a rent increase, as well as the preservation and extension of all the terms and conditions in the lease. The landlord should send this form to the tenant at least one or two months before lease expiration to give the tenant an opportunity to consider any rent increase and to respond with enough notice time to vacate or renew tenancy according to lease requirements.

Tenant Screening with Facebook and Google

A few minutes of searching Facebook and Google can pay off big-time. I am flabberghasted at what information, pictures and behavior some people post for the world to see! I've even seen pictures of people wrecking their landlord's house! I've also seen pages of the nicest people. I'm glad we have another source to check!

Tenant does not have a written lease. We rent our parents house after their passing. My brother lives in the basement to keep up the property. The tenant moved her boyfriend in and now they want my brother out. We want them out. What are our rights as the owners of the house and what do we do to get them out. We also never gave her permission to move her boyfriend in nor did she ask. The verbal agreement was for her and her children. - Tina Brogan, Missouri

A: You may not base an eviction on the boyfriend, but you don't have to. It's a verbal month to month. They need a written 30 or 60 day notice and then eviction as "hold over" tenants. Shouldn't be a problem.
