How to Remind Tenants of Lease Responsibilities

Did the Tenants Forget Their Responsibilities?

Fact: As time passes, it is common for tenants to forget some of the details and obligations they've agreed to in their lease agreement contracts. Landlords should be ready to enforce the terms of the lease whenever the tenants forget or neglect their responsibilities.

Many landlords will purposely overlook or ignore small violations or tenant ignorance of the agreement in order to avoid "making waves" in the tenancy.

The Lease Obligations Reminder Letter allows the landlord to enforce the terms of the lease by politely bringing the tenant's attention to certain items and covenants in the lease agreement that may have been overlooked or forgoten about.

It is important to enforce the rental contract terms as soon as it is apparent that the tenant is not understanding his or her responsibilities.

    This is one of my favorite forms because it saves me time and money when tenants move out according to our instructions. It is often overlooked, but I consider it an "essential form" just the same.

    We send this form to the tenants about a week or two before they vacate. It reminds them specifically of certain tasks and cleaning they should perform in order to get a full security refund. This letter instructs the tenants how to lock up and secure the rental until it can be inspected by the landlord/management, and also where and how the tenants should return all keys.
    We have found this form to be very effective in helping tenants to be more cooperative when they are moving out.

    Dear Mr. Reno:
    I have a pair of couples who rented my house, and they all 4 signed the lease. I added a termination clause, that the lease can be broken with a 30-day written notice, and payment of a one-month termination fee. One of the couples has given their written notice, which is causing the other couple to move out also as they cannot afford the house on their own. The couple who gave their written notice is only paying me ½ of the termination fee, claiming that is how much they paid for rent. Technically I suppose that sounds credible, but obviously the other couple will not pay half, they did not want to break the lease and was not their idea. My question, is the couple breaking the lease responsible for the whole month fee? Is it worth going to court over? ($500)

    A: They should pay it all! You should send them all a letter, they're in breach- if you don't get it all- they'll (all four) be responsible for any lost rent until you re-rent. Whether or not its worth suing, that's your call.
