Careful Tenant Screening

by John Nuzzolese

From the time of first contact with the prospective tenant to the time you sign a lease with him or her, you are still in the tenant screening process. Keeping in mind The LPA article, How to Screen and Qualify Tenants in 5 Easy Steps, it is very important to decide beforehand that you WILL NOT accept anyone who does not meet ALL of your screening requirements.

Often, landlords overlook certain "red flags" that indicate the prospect is NOT qualified to rent from you. It could be a sign of the tenant's financial stability, personal habits, respect or attitude toward the landlord. The important thing I'm saying here is, do your homework.

What are your screening requirements? It's important not to forget some of the key ingredients when screening a tenant.

  1. Rental Application
A fully completed and signed LPA Rental Application.
  2. Identification.
Be sure you get a copy of the applicant's drivers license or other valid picture ID. Is it possible that a deadbeat would use someone else's identity and credit to get accepted as your tenant? You bet. It happened to me!
  3. A Non-Refundable Deposit.
A serious applicant will have no problem leaving a substantial non-refundable earnest money deposit with you to secure the rental...

Bush Tax Cuts - Letting them expire hurts small business owners
    By Dr. Danielle Babb
Dr Dani Babb Here is what we face with the tax cuts expiring:

Couples earning 375,700 or more will have a 4.6% increase Families earning between 232,950 and 375700 will pay 3% more 210,400 to 232,950 will pay 5% more -- this is the hardest hit class percentage-wise

In total, 36 million people reported small business income in 2009. This is 24% of all tax filers. We aren't talking small numbers here.

Since many business owners report their income as personal income, many actual businesses will be affected...

Submit a landlord / tenant question for Mr. Reno
Please try to keep your questions as short and to the point as possible.

    Dear Mr. Reno:
We are the owners to our property and just moved in 2 months ago. Going thru the files we found some tenants who have pets and have not paid a pet deposit. We have one tenant who never paid his security deposit. Can we have them pay even if its been 6 months or more since? The previous managers never followed up. Thanks, Diane, Alaska

A: If it's in the lease, it is enforceable, but there's a catch. In some jurisdictions, the eviction court only has jurisdiction over rent. So in those places (like in my area) you can only evict if the lease categorizes these things as "added rent". Either way; you can sue for a judgment; the only question is can you evict.

    Criminal Background & Release Form

The Criminal Background Authorization & Release Form will remove any doubt of whether the tenant is being up front with you. Not only will you have the tenant's full authorization to do a criminal report with law enforcement agencies, you also have the written authorization required to obtain a credit report.

The fact that the tenant has nothing to hide and is willing to release credit and criminal (if any) history to you shows good faith and cooperation in the screening process.

This form should be used in addition to the LPA Rental Application.

    Where's the RENT? Tenant Excuses

"Juuuust because you are aaaaasking for it .....AGAAAAIN- doesn't mean I'm gonna have it OK!?" I'm not even going to bother with a witty comment. My lawyer is serving eviction papers to this annoying thing. - Jack, NY

"I left the house, am getting married and leaving the country, so I'm not paying the rent." What he really meant to say was he's on the run from the law because he used the house as a drug stash house, 2054 lbs of pot. With my help he's now in jail. - Ken F.
