Every New Year, I find find myself reflecting on the last year and planning and setting my goals for the year ahead. My goals and the possibilities always excite me! Thinking about my goals for investing and also dealing with rental turnover, I said to myself, "Attack the New Year! I mean really ATTACK this whole next year and SUCCEED! After all, it is going to attack you anyway, so why not GO FOR IT?" Let's make this a good year!

How to Remind Tenants of Lease Responsibilities

Did the Tenants Forget Their Responsibilities?

Fact: As time passes, it is common for tenants to forget some of the details and obligations they've agreed to in their lease agreement contracts. Landlords should be ready to enforce the terms of the lease whenever the tenants forget or neglect their responsibilities.

Many landlords will purposely overlook or ignore small violations or tenant ignorance of the agreement in order to avoid "making waves" in the tenancy.

The Lease Obligations Reminder Letter allows the landlord to enforce the terms of the lease by politely bringing the tenant's attention to certain items and covenants in the lease agreement that may have been overlooked or forgoten about.

It is important to enforce the rental contract terms as soon as it is apparent that the tenant is not understanding his or her responsibilities.

    I currently use the rental binder and deposit receipt from the landlord protection agency as a agreement when renting out my furnished rooms. I am currently in dispute with a former tenant over deposit money and his attorney has advised him that the agreement is not a legal document? I printed it from the website could this be true? thanks.

    A: The problem is you say a lease will be signed. So its an agreement to sign an agreement. This is a complicated legal issue. I think it's valid. But it depends on what goes wrong after that. In any case, it's better to have it, than not have it. (In a perfect world you'd have the lease already for signature.)

    The rental binder & receipt form is just that. It was never meant to be a substitute for a lease or rental agreement. Why not invest ten bucks in a real rental agreement and make your life a lot easier?

    Landlord Resolutions for the New Year:

    I will
    • Screen tenants carefully and completely before accepting them.
    • Enforce my lease terms quickly. Also use the LPA's new form, the Lease Obligation Reminder Notice periodically.
    • Enforce rent being paid on time. Charge late fees and send notices promptly.
    • Replace bad tenants with qualified good tenants.
    • Do repairs that need to be done. Fix things quickly before they grow into bigger problems.
    • Take a serious step to improve myself as a landlord: Read a good landlording book, Join The LPA or another landlord association and learn the details of a good lease agreement.
    • Arm myself with the best landlording forms around so I can deal with tenants better.
    • Have lease renewal forms with reasonable rent increases ready to go out on schedule.
    • I will not return security deposits until after tenants have left and I have completely inspected and deducted for repairs and other charges. For this I will use the Security Settlement Statement.
    • Sleep better at night knowing I've got things covered.
