What NOT to Say to Prospective Tenants

We always try to say the right things during the rental process, but sometimes the prospective tenants hear something that scares them off. Most savy landlords know what to say and what not to say, but amazingly, people still say stupid things to prospective tenants. Here is a helpful and sometimes humorous look at what I have personally heard landlords say to prospective tenants.

  1. Discriminatory Statements or Questions can get a landlord into serious trouble as they are a violation of civil rights and the Fair Housing Act.
    • "I don't think you'd be happy here. This is an all ___(race, religion or nationality)__ neighborhood."
    • "I can't stand the smell of that kind of cooking."
    • "Are you two people gay?"
    • "I only rent to married couples. I need to see your marriage license."

  2. "I want the rent in CASH."
    Statements like this can lead the tenant (often correctly) to the conclusion that the landlord is not reporting the rental income to the IRS. If and when push comes to shove, tenants love to threaten that they will report you to the IRS for tax evasion.

  3. "I live in Beverly Hills."
    Don't brag to a tenant about where you live.
    • They should not know where you live.
    • They do not like to hear about how well off you are and how their hard earned rent is paying for your mansion and car.

  4. "My last tenant owes me 6 months worth of rent, plus I lent her some money when she got in trouble. How can you ignore someone who comes to you for help, ya know?"
    This kind of statement invites your new tenants to use you as their new ATM when things get tough.

  5. "My previous tenant is suing me for her security deposit."
    Why in the world would you share this information with a prospective tenant? It sounds like you are in the habit of not returning the security money.

  6. "Do whatever you like to the place. I'm sure whatever you do will make it even nicer."

  7. "If you have a problem with anything, let me know. I'll fix it."...

    Dear Mr. Reno:
    We have a lease with tenants until end of June 2011. They called to say they bought a house and are moving out. They have 5 months remaining on the lease, can we expect to receive the 5 months in payment? They did not notify us within the 60 days as stipulated by the lease. They also tried to come up with some reasons to break the lease (or so it seems to us) as they had to be in negotiations when they said the oil burner was too loud for them to sleep. We contacted our boiler company and they couldn’t come out for 2 weeks, and then it took another 2 weeks to fix. What should our expectations be when we speak about the broken lease? The tenant’s include a retired ADA from Santa Clara, CA.

    A: You probably have a law suit brewing after they leave. Send them a certified letter that you'll be holding them responsible for any months during the lease that the apartment is vacant. That should get a rise out of them.

    Dear Mr. Reno:
    Most of my tenants are 2 friends/ couple that sign a month to month lease with me. They are all mostly 30 yrs. and younger. I've run into problems when one tenant wants to move out- and the other tenant has a hard time finding a new roomate. Would the remaining Tenant be legally responsible for the whole months rent after his/her roommate moves on? Can I keep the leaving tenants security deposit to put towards the rent? Thanks. Ms. D.     A: This comes up often. If 2 or more tenants sign one lease, they're all fully responsible for the whole rent. If a roommate leaves, that's their problem - not yours. The security does not apply to only one half of the tenants - it goes for the whole thing. So don't get involved. Let them sort it out.

    Landlord Tip
    Toilet bowl maintenance can save you money

    I opened up my water bill and could not believe my eyes. Our normal bill is around $60.00 for three months and this bill was $197. There must be a mistake! I called the water company very upset with this bill. Someone must have read my meter wrong!

    Well I was the one wrong. The water company was very polite but insisted we had a leak in our house .Most times it is the toilet they said. I checked the faucets, the outside faucet, the pipes and could not see anything. Then I checked the toilet guts. I could not hear the water running but it was.

    The flapper was not shut tight against the bottom of the toilet. It was a constant run of water. Could this be the cause?

    I changed the guts of the toilet with a repair kit for $9.99. The next water bill went down and now our water bill is back to the average $40.

    Now when we prep our houses for new tenants, we change the toilet bowl guts as part of the normal routine.
