What Do I Do if the tenant abuses the utilities that I pay for?

I never recommend having your tenant's utilities in the landlord's name. BUT, if the tenant is on an LPA lease that allows you to issue a Notice of Change of Terms or a month to month tenancy, you may have the power to do something about it. When your tenant abuses utilities that are included in the rent, you should alert the tenant that the utility bills have reached excessive levels and the tenant will be billed the overage amounts or the utilities will be paid by the tenant in the future. A lot of this should already be addressed in the lease. If it isn't, you left the door open to problems.

Dear Mr. Reno:
I have not been asking tenants to submit a deposit (non-refundable) but I have recently had several prospective tenants “bail” at the last minute and because I naively thought they were committed, I stopped advertising the house. In once case I had moved some furniture into storage to accommodate the tenant's request and now have to move it back. Can I ask for a non-refundable deposit and at what point? Should it be a percentage of the rent? Should I declare that in the ads I place?

A: You can ask for a non-refundable deposit, but whether you can legally keep it is a complicated question. But it's still a good practice because it will discourage "back-outs" and separate the serious ones from the game players. As for the amount, I've seen $200, $500, or even sometimes the entire security deposit.

Funny Landlord Story

"Marshmellows"

Many years ago while looking for our first apartment, my then, future husband, (now hubby of 46 years) and myself, found out that a gentlemen that I worked with had an empty apartment so we decided to check it out. We loved it and decided to take it. While getting the information (how much and who to make the check payable to) is when I started laughing uncontrollably. His name was Gilbert Mello and he said "you can make the check payable either to me or my wife Marsha". Well as I started writing out the check I was laughing so hard that tears were coming down my face. They were all just looking at me wondering what was wrong. When I finally composed myself I showed them the check payable to "Marsha Mello"...... This was the beginning of a long and wonderful friendship.
