A partial payment will stop the eviction. What you have is an experienced deadbeat working you. Let them cry, plead and beg. You are not running a free homeless shelter which is what you will be doing if the eviction is stopped. Under no circumstance should you accept a partial payment and stop the eviction. Have no further contact with your tenant. If they should show up at your door, shut the door while telling her you are calling the police. This person has had plenty of warnings, deadlines and past dues. It is time for them to move on and out of your life. Be prepared for your unit to be a real mess when she moves out that will cost you plenty in addition to lost rent.

Thanks for clarifying that- I believe she thinks she will get out of the eviction by making a partial payment. She actually called today and left a message that she was going to bring the check out to our house - but we were not at home. I am concerned about handling her personal property after the Writ is served and she is removed from the house. She has tons of stuff (nice) Not sure how to make arrangements for her to retrieve it if we don't speak to her. I don't expect a mess unless she really flips out about this. She is neat and clean and has expensive "things" (shopaholic, but the rent is at the bottom of her list, sigh)

Hi SD, Sorry you have to go thru this. I've had to as well. I wrote you further down below I didn't know then that you are in Mn. Like I said if you can accept partial payment as we can in IL(that doesn't stop the eviction)make it clear to her,this is the result of HER choices. Funny,they don't see it as personal responsibility on their part and the consequence of their bad decision making process. You don't want this type of tenant,because she'll only pull this again,and again thinking tears and a partial payment will save her behind. Time for her to learn a very belated life lesson. Thanks Teena! This was tough as I do like her and I have never had this problem in 15 years! I have issued 30-day notices before but those tenants took me seriously and actually moved out, lol!

My tenant has my bank account #. I gave her 3 day notice. How I could avoid situation that she would deposit money to my account after I file eviction. I really want her out of my house.
