Odd Question, but I'm Pissed! by Carl (WI) on August 20, 2012 @12:57

I know you guys will laugh and call me a "troll", but here's my very real situation.

I own a home in Green Bay, Wisconsin. My job took me down Lake Michigan a ways towards Milwaukee, but I do plan on living back in Green Bay when I retire in a few years, so I am renting the place out as I do not want to sell it. As you can imagine, people are VERY fanatic about the Green Bay Packers there. My new tenants lied to me on my application and are actually Chicago Bears fans! They have made this known by putting out Bears crap all over the front lawn (flags, lawn gnomes, placemats, etc.). This has pissed off my neighbors something fierce as they do not want to live next to such blowhards.

Can I evict them based on their lying to me on my application about being Packer fans? I would never have rented to them if I knew they were not as my house is located within walking distance of Lambeau field. I'd rather take a loss and stay there the 8 times a year I go a Packers game instead of renting to some Bears fans.

Any help you can give would be appreciated.

"troll" is not the term I personally would use to describe you in this situation.

I think you'd have a problem if you pushed for "eviction" about them lying on the app about being Packer fans. That's a stretch but hey, who knows?

Eviction is generally used for breaking a section of the lease or rental agreement, i.e. damages, non payment of rent...not because someone is a fan of a different team.

I don't know if you have a lease or M2M rental agreement, but you may be within your rights to ask them to remove stuff from the front lawn (not so much the wipe-your-feet-mat).

If you have a M2M, give them notice. Hopefully you aren't in a state where you have to state why, because your reason may be considered frivolous.

No judge will allow you to evict on this basis. I believe it is a 1st amendment issue...

You had a question on your app as to which football team they like the best?

No court in the 50 states of America will grant you an eviction based on that reason.

If it's a year lease, at best, you can tell them to remove the ornaments from the front lawn if you have a clause in your lease that addresses the lawn or property decorations.

Perhaps a better bet would be to let your tenants know the neighbors are feral about their football team affiliation and have expressed hostility to you regarding them, so to keep the peace dial back the front decor and perhaps move it into the backyard.

Also, let the neighbors know that you can't do anything about it and they will just have to tolerate it in a civil and adult manner.

i cant believe you would have the nerve to even have something like what team they liked on a rental agreement a persons personal beleifs or personal life is none of your business thgese people are paying you to live in your house not for you to be able to controll their lives and tell them which teams they can like and which ones they cant...if the neighbors have packers signs up these ppl have every right to have the same for whatever team they like

Why oh Why are you people even responding to this nonsense?
Re: Odd Question, but I'm Pissed! by Anonymous on August 21, 2012 @08:17 [ Reply ]
I don't have anything to really add other than I live and work in the Green Bay area and can attest for how crazy people around here get about the packers.

With that in mind, the renters have to know what they are doing. If this place is truly as close to lambeau field as OP says it is, just wait until the next game when foot traffic from people renting parking on lawns drives tons of people past the rental. Eventually a (probably drunk) packers fan will steal/vandalize his decorations; it will get expensive to replace them after every home game. Just hope they don't damage your rental in the process.

So I was listening to our local sports talk radio station in Minneapolis and this story was read on air and talked about for like 15 minutes. Go to iTunes and search for "Dan Barreiro-kfan 100.3". listen to the 4pm hour segment and it starts around 25 minutes in. It's HILARIOUS! I laughed quite hard...

Just thought you'd all like to know.

I'm a Lions fan so I probably shouldn't be offering you any advice, but I'm also a bears hater so here goes. I'm not sure of the eviction rules in your jurisdiction, but where I live in Canada we have a rule that allows you to evict if it is because you want to make the residence available for one of your immediate family members. I know this because I got evicted for that reason back in 1999 even though I know that is not the real reason they wanted me out. They wanted me out because I was smoking in the apartment (the landlord lived downstairs) even though I told them I was a non smoker (which I was at the time) when I moved in. So if you have any family members that could help you out maybe you can get rid of these bears fans once and for all.

If this is the case...why does it surprise anyone that a Packer fan is dumb enough to mess this up! That's what you get for asking that question on your rental form. By the way, get ready to be stomped on twice by the beloved Bear!!!

My advice to you is to forget all about this and try doing something different like, say, taking your sister out to dinner before taking her to bed.

I myself am a bears fan, and somewhat understand what your asking. And a few years ago around the time we played in the NFC championship a car dealer in Chicago was fired for wearing a packers tie. However he sued and won. He can however sue your neghibors for vandalizing his property and pursuit of happiness, and if you hold him responsible or know the parties doing the damage he can also sue you untill the point he owns your house. Oh yeah and winning record speaks for its self bears with more w's over green bay so BEAR DOWN!!!! see ya week 2

That's awesome!!! You "Cheeseheads" are so gullable. Maybe they WERE Packer's fans and didn't lie on the application ... and MAYBE they switched after living is that shithole called Green Bay :D. Hilarious! I hope your house gets trashed by all your neighbors and the drunk fans on their way to/from games. What do you charge for rent ... a six pack?!!! Thanks for making my day with this post. TGIF and CHEERS!!!

Re: Odd Question, but I'm Pissed! by Anonymous on August 24, 2012 @17:32 [ Reply ]
You can’t be serious. Football is a game. You are not a player and neither is your tenant. Your worthiness as human beings is not dependent on how groups of other people drawn from all over the country perform in a game. I suggest that you simply provide your tenant with a friendly chuckle the next time you see him among his ornaments on the lawn. He’ll chuckle back, and then you can talk a little football and perhaps some more substantial matters while enjoying beer and munchies.

Of course you can evict using the logic set forth by Chicago Mayor Rahm Emanuel himself.

The renter does not exhibit "Green Bay values" and therefore is most unwelcome.

Out with thee!

I feel your pain, Carl. I'd place an ad on Craig's list, in classifieds in the Green Bay Press Gazette, area shoppers guides and/or Milwaukee Journal Sentinel:

"OBNOXIOUS CHICAGO BEAR FANS MAKING LIFE MISERABLE for neighbors now living in rented home of Packer fan. House within walking distance of Lambeau field. Neighborhood want them out/needs help. ASKING ALL GOOD PACKER FANS TO MAKE LIFE MISERABLE for corrupted flatlanders. BE CREATIVE (tho leave property alone)! NEIGHBORHOOD WILL BE FOREVER GRATEFUL. Address is XXX. Phone number is XXX. GO GET 'EM!"

I'd run this ad once/week in Craig's List & shoppers guide:
"We are Bear fans living close to Lambeau, making life miserable for neighborhood! Having a blast!!! However, being harassed by few trailer losing packer fans. PLEASE, PLEASE SHOW US SOME LOVE. CALL US AT xxx-xxxx, ONLY AFTER 10PM. THANKS!"

may not be able to evict for lying on application but you could push it under the fact that due to their sports affiliation and the proximity to the staduim that your house is more likely to suffer acts of vandalism... due the the amount of football decor the tenants have placed in view of the public.

What type of lease is it?

If you have a Month to Month lease, you do not need a reason to evict someone using a 28 day notice.
