I have a tenant who's girlfriend is over there a lot. Her name is on the mailbox and she gets packages delivered there. The other tenants claim that she parks in their (marked) spots. I have only seen her there once. One tenant said that she's there for a while then she doesn't show up for a while. Can I claim that she is an unauthorized tenant and that the tenant is in violation of his lease? I've given the T 30 days notice but he is making no effort to find a new place. I want to send a "reminder" letter with the intent of pointing out the lease violations and that he has to be out by a certain date.
now that I've sent the 30 day notice (this was done before I noticed GF's name on the mailbox) do I have to wait the entire 30 days before filing an eviction? What will be the surest, fastest way of getting him out? Thank you

No... you can post the "cure or quit" today. State that the gf is not a legal tenant and must move out in 3 days. Do not even get into the argument about if she is or isn't living there, you have all the proof you need.

Include a letter "eviction ramifications" with the "c or q" notice.

My guess is that the tenant will be moved out before you get through a court room and get the eviction order from a judge anyway. But...it will sure encourage him to get out of there quick. After all, the notice you are going to post is a "Cure or QUIT"...meaning he can move out to solve the problem or throw the gf out. So, maybe you get lucky and he gets gone fast.

why are you evicting him? just because his girl friend moved in?

I'd give her an application, tell her where to park her vehicle, and adjust the rent (or not) as the case may be.

Check your state's rental laws. My state, if the guest stays more three nights, she is an occupant. Or so many days during a monthly rental period. Getting mail and staying overnight there shows she is an occupant. An unauthorized occupant is grounds for ending the lease.

The fastest way to get him out is a notice of intention to evict if he is not out. You will need to evict AFTER he is there past the thirty day notice. Stirring him up now is more than likely going to cause him to leave the place a mess. YOu might do best by contacting him, and mail or give him a moveout checklist, reminding him to have the place as clean as it was when he moved in, and that he will receive his security deposit back in the time frame determined by the state's rental law. (In many states, the security deposit return is within thirty days after his exit, and surrender of the keys.....)

My experience is it pays me to play nice, right up to the point a tenant is out, and I get the rental property back in better shape. This is true even when I have had to give a tenant notice to leave.
