My tenant is a chiropractor and I do have this rental in an LLC.

I knew when I rented to him last year that he had closed his office. He told me that he was going to be moving his business in with his Dr. friend. I just discovered that he appears to be operating his business out of the home he is renting from me. In the last year he has been a perfect tenant, always pays early, never complains, changes the furnace filter monthly, takes care of the house and fixes things himself (with my approval), etc.

Assuming he is seeing his patients in his/my house, how concerned should I be? What kind of legal issues should I be thinking about? Of course my lease says this is a no-no but these kinds of tenants don't come around too often.

Never mind. After doing some more research I now know this is a terrible idea on many levels.

Yes, it opens you up to many liability issues. Unfortunately, you may lose your tenant over this, but he has not been completely honest with you about this, so it may be time to let him move on.

My advise is to talk to your insurance agent. After all, you have to answer to your insurance company.

who goes to "the doctor" in a private residence? aren't these guys overseen by the medical board? aren't three certain restrictions/parameters/whatever about their offices?

I wouldn't permit it and I'm easy going as a landlord.

You should already have it in your lease that no home businesses are allowed. Either way, tell this guy no more. Chiropractors can't make a living anymore since the work comp racket dried up for them. Other insurance barely pays them anything for a visit. They can't pay overhead on an office, but that's not your problem. Put an end to it.
