Thankfully I have never had to evict someone. But the stories of how long it takes makes me cringe. Are there things a landlord can do to make the squatters life miserable enough to leave on their own? I know utilities can't be turned off. But surely there must be gray areas you can play with to frustrate them to move out.

follow the advice here. Post your notices the second they've broken the lease and then file for eviction. However much it costs you to file will be a heck of a lot cheaper than not getting rent and then having to file down the road because nothing you've done has worked to get them out. Just do it. Most of the time when my slackers get their eviction notice from the court they are out fast. Not all the time but most of the time.

Making life miserable for squatters comes back to a landlord in terms of property damage before the squatter leaves. If you truly want to make life miserable for a squatter proceed with the eviction that will do permanent harm to his credit and remain forever in his civil records.

The easiest eviction will always be for non-payment of rent. Not is a slam dunk...either they paid the rent and can prove it..or they didnt. No mystery involved.

In New York I can have the entire process from first posting to out on the street in 24 days. Meaning...if I don't get the rent on time they will be on the street by the 3rd week of the same month. Lesson is...do not wait around .. Post the quit or pay the first day the rent is late. If the tenant is upset about it...tell them you have to do it that way to preserve your right to proceed directly to court if a tenant doesn't pay quickly after the notice is posted. Even if you have a deal with the tenant to pay on a certain day ..still post the notice right away so you could go directly to court to file if they break their promise.

The key is..know the process before hand (if we knew your state we could offer much more specific advice), and do not delay taking those steps in the process.

Never forget...the easiest way to avoid problem tenants is to avoid problem tenants. Screen. Screen. Screen. Before you rent to anyone.

I just filed an FED (eviction & request for money judgment). Filed it on the 18th, court date is the 28th. You just can't beat that! I normally post/mail the p/q notice on the 2nd of the month, delayed this month trying to work with these deadbeats -- no good deed goes unpunished, so now I'm at the end of the month getting them out. Once I have my judgment on the 28th, I file the writ for possession on the 29th and the Sheriff schedules a set out on the 31st or 1st. If I'd done the right thing and posted/mailed the p/q on the 2nd, they'd have been out by the 15th and I'd already have a new tenant in with only a half-month of lost rent. Shame on me!

Play by the law and enforce all lease infractions. Notices must be served as required. Enforce late fees. Document all the violations. Inspect the property more. You don't have to circumvent the law to evict. You need to document, enforce, follow through.
