What do you mean by "separation"? Is this a legal separation or just they aren't living together?

Because the speakers at my apartment association continue to claim that spouses can not be evicted if they move into the same apartment that their spouse lives in.
You may still be able to deny or evict if their information disqualifies them from your rental, such as evictions or bad credit.
So since technically the spouse can technically move into the unit according to the way the courts have been approaching this; I have both fill out an application and in this case both signed the lease.
Luckily, these 2 people agreed to do it this way and they seem like good tenants.
I haven't gotten a straight answer from even attorneys on how to approach this.
