On Aug. 8 applied for apartment $70. At that time was informed to sign lease and give deposit of $430. Lease was left blank but was told they cant submit for approval until I signed. Rental not availalbe until mid - september. On Aug. 10 I called realitor to check on application. Was informed they cant rent to me because "You are a son of a bitch who should not live near anyone since your am a felony." and they kept going for several minutes even though I told them I didnt know what they were talking about - I asked for my money back. The follow day they called and said the papaers had an error and I can rent since I am not a felone. However, the follow day after that I informed them I didnt want to rent from them for their treatment and asked for my money back. I called several time between Aug. 15 and Aug. 29 asking for my money but was told several times you signed a lease for a year and my credit will be damamged. On Aug 29 they send me a lease with a start date of Sept. 12th. For the following two weeks I repeated informed them I did not want the unit and asked for my money back by they continued to inform me they will take me to court if I didnt give them the cash for a years lease. Now the realitor is demanding I sign an agreement that they can go after me and my credit- and requested I sign and return by noon tomorrow. (9/18/2014) I decided to go by the unit- I went there knocked on the door and a woman answered- her neighbor was coming up staris at same time- I asked her if she just moved in and she replied Yes as of 9/12 she moved in and her neighbor confirmed. The realitor refuses to return my security deposit which states its only for property damages, informs me they are taking me to court to pay rent. How can they when the unit is already rented to someone else?

It is the exact same thing as signing a blank check. Geez.

The agent is a thief and I am sorry but there is little you can do about it.

Write a letter to the broker of the real estate company that the realtor is with and tell them to return your money or you will report them Real Estate Commission in your state. Realtors can lose licenses over this kind of stuff. Also mention you may report the real estate agent to the National Board of Realtors.

Please make an effort to write your letter more carefully than you wrote your post. It's full of errors and hard to understand because of the poor writing, and many grammar and spelling errors. If you have trouble writing clearly, try to get a friend or family member to help you. Make the letter professional. Simply state what happened and tell the broker of the real estate company that their realtor's treatment of you has been unethical, if not downright illegal. Tell them either they return the deposit of $430 or you will take further action, such as reporting this to the Real Estate Commission of the state you live in.

Don't ask for the $70 back. That $70 was used to run the credit report and process your application and it isn't refundable. But, since they told you they weren't going to rent to you, they should have given you back the deposit of $430. Too bad they changed their minds. And it's awful that the realtor was so unpleasant (verbally abusive) and unprofessional about it. Everyone, even a convicted felon (which you are NOT) is entitled to be treated with dignity and respect.

I would not threaten to get an attorney. They know most people aren't going to pay $200 an hour for an attorney to try to get $430 back. But writing a letter of complaint to the state Real Estate Commission costs nothing but your time and effort and a little postage...and it should put the fear of God into them because they could get fined or sanctioned or lose their real estate license. If you are a minority of any kind, you could mention the names they called you and what the realtor said and tell them you think you might have a Fair Housing complaint because of the way they treated you.

I used to be a realtor; my mother has been a realtor for over 30 years. I hate it when realtors mistreat clients and act unethically! Let me know how it goes and if you get back your deposit.

They probably can not take you to court since they did not allow you to move in.
Take names, as well as get the name of the girl that was moving in on the 12th.
Keep a record of when you made the phone calls. I would be mad enough to go down and file a claim against them in small claims court. It is like 25 dollars to do this in my area. At least check and see what a small claims case would cost you. The 70 dollars you will not get back. The 430 is another thing.....

You can also threaten to file a complaint with the Better Business Bureau. It may not be directly effective in getting your deposit back, but if they're concerned with their reputation in the business community, it might help.

If they don't respond to that, go ahead and file the complaint, as it may save another prospective tenant from falling victim to the same scheme.

Go talk with your local district attorney office, to see if this is fraud case

Spoke to free 30 minute legal assistance: Was informed to hire attorney, of course, to write letter to realtor. That writing the letter would not guarentee the deposit would be returned. ... That the realtor cant ask me to pay rent for something that another person is paying the same amount of rent for the same space.... and if they attack my credit then I will have to dispute that too.
