I'd want to modify the original rental agreement that the renter signed five years ago. Can the late fee of 75$ after five days be changed to being late after three days and increased to 200$. She always pays the rent on the fifth day of the month. I'd also like to increase her rent 100$ a month.
What would be the best way to make these changes

Write a new lease. Put the new terms in the lease.

Get her to sign

Most state laws say that after a lease expires...the terms remain the same but the period becomes month-to-month. So write the new lease to be effective Oct 1

Be prepared to have her give you notice and move out

So..think this through. You have a tenant paying the rent (ok..late..but paying). She has been solid for you for 5 years. Now..think about the cost of turn over. You are empty for a month and you probably have to put a fair amount into the place...5 years of normal wear and tear is going to have a cost to you that is not to be ignored. You cannot charge the tenant for normal wear and tear. So...you will probably have many months to recover that cost and get back to break even.

If you have collected the rent every month on the 5th, why do you want to mess with it?

If you want her out, don't beat around the bush. Give her notice that the place will no longer be rented as of such and such a date. You don't have to give her a reason.....
Start fresh with another tenant.

Yes, you can modify your old lease with those few changes by using a "Lease Addendum" form downloaded from this site.
Another poster said to make a new lease; that can be done also.
I suggest when you mail the "Lease Addendum" form or new lease, that you include the LPA form that says the tenant is giving you notice to leave in 30 thirty days if she does not sign your new lease.
