If this is not your homestead it will not matter what kind of relative lives there and if that person pays rent or not. The IRS could get hold of this one day and tell you that taxes are due on the unpaid rent of the relative. The tenant can take you to court one day and ask for a refund of all rent paid because your place is not legal. Then penalties will follow from the city. It is a quagmire.

In addition to the problems listed above, you will not get the help of a court to collect overdue rent or to evict a tenant. You will not even be able to evict the tenant living for free.
