Dog left in dads house by brother

My dad allowed my brother to move into his house a year ago. Dad went into rehad and brother got a dog. Dad asked him to get rid of dog, he refused. Dad has since gone into nursing home and brother has left dog there while he works out of town. Has someone come to take dog out twice a day. Dog is crated 24 hours a day. We are trying to get house ready to sell. Can I take the dog out since it is his dog. Animal Control says no. I have full POA and need to get him and the dog out. What are my legal rights?

Its animal abuse to leave a dog in a crate 24 hours a day with only 2 outings a day. I would call the authorities to report the animal abuse. If no one is able to take care of the dog then it should be given to a no kill shelter where it can have a chance to live a normal life.

I wholeheartedly agree with B. Leaving the dog in a crate this long is abusive, and I hope you will place the dog in a no-kill shelter until it can find a good home.
If you would tell us your state, perhaps someone on the forum will know of a suitable shelter.

I agree with both B and Becky, that it's abuse. But unless you have PROOF about it being caged all most 24/7, nothing can happen---- YET. If you have full POA. then contact an attorney tomorrow, and find out how to get your brother out LEGALLY, probably by giving him a 30 day notice to move, and evicting him if he doesn't.

You should rescue the dog and not is your chance to get rid of your brother too. Put his things in storage and inform him he needs a new place to live. Tell him you are getting the house ready to sell and that he does not live there anymore.
This could be a case of abandonment if he does not live there anymore and has moved to another city to live and work.
