Yes I see this an know this. Oct 4 I handed her a letter saying the lease is not being renewed. November 30 lease expired. December 8 sent certified letter for demand for possession and holdover. My question is how long do I have to wait to file for eviction? After the dec 8 th letter? The law is not clear. Do I have to give her more time or can I file today?

You didn't read this? 5 days
Then go file with the court for eviction.
That is it.
You get possession when a COURT gives it to you.
Get it?

You gave her notice per 735 ILCS 5 s 9-202
Then, when she failed to pay
You have her 5 days notice
GO FILE FOR EVICTION. N O W
Holdover Tenancy Willful Hold Over,
735 ILCS 5 / 9-202
A tenant who willfully stays after expiration of the lease term must pay double the value of the unit. The landlord must demand in writing possession of the premises before claiming double rent. Hold Over After Notice,
735 ILCS 5 / 9-203
A tenant who gives notice of intent to vacate the unit and who stays beyond the date mentioned shall pay double the value of the unit.
