Make a long story short, I have a sec 8 tenant that is on a month to month lease, ive already informed her that her lease will terminate at the end of march. My question is if she doesnt pay her portion of her rent for march,and I file for eviction , do I have to accept her payment if she tries to pay after the 7 day pay or quit notice is posted? Id rather not accept it and continue with the eviction process. I have a feeling she will try to stay after the 30 days and id have to file eviction anyway. Id rather start it now, if she doesnt pay...thanks

What do you think a "7 day pay or quit notice" means?

Believe it not, it's believed that the tenant has a choice to move out (quit) or pay the rent (pay). Do you believe it means something else, if so, please explain.

You can post, and send by both regular and certified mail your 7 day notice tomorrow, March 2nd And you must send the same notice to Sec 8 also. Don't worry, she will pay her part within the 7 days, because Sec 8 will tell her to do so. You see, she cannot be on the Sec 8 program anywhere if she gets evicted. So she has a much bigger incentive to pay her part, than you have in not wanting to accept it. And if all your paperwork and time frames are correct regarding the 30 day notice to move, if she stays past the 30 days, you can start eviction procedures for that violation. Regarding the acceptance of rent after the 7 days is up--------probably no, you wouldn't have to accept it, BUT,you need to read the LL/T laws for Ky to be absolutely sure, as some states do allow acceptance clear up to the court date.

here's the problem I had;

reported to Housing Authority tenant not paying her share, Sec.8 paid $890 - tenant to pay $158/mo
Sec. 8 cut off payments immediately

took me five months of filing papers, trips to CHA, lawyer visits and finally evicted = physically thrown out with her five kids on the front sidewalk with their trashy belongings

NEVER ever rent to Sec. 8
