Tenant trying to stay past lease - Landlord Forum thread 362366

Tenant trying to stay past lease by Jeff on May 8, 2023 @08:32

I have a tenant who is attempting to stay past his lease by 3 weeks. Seems as if my options are very limited in this state. Is it worth trying to evict? Im sure I will be able to make a claim on the security deposit right? Additional months rent? We are trying to sell the house and the first week of June is hot and the best time to be on the market in Florida. This will possibly cost me tens of thousands of dollars in the Sales Price because the market will be much drier come July. I had initially inquired at 60 days until lease expiration if they wanted to renew the lease. After a few days they said they would. 15 days later our circumstances changed and I informed them I would need to sell the house and the lease would not be renewed. This still gives them 45 days to find a place to live. They say they have a contract on a house but cannot leave until 3 weeks after lease is up. Any advice would be appreciated

Hire an attorney TODAY if you want the tenants out. YOU are the one who led the T's to believe they could stay, and then abruptly changed your mind. So it's on YOU if you lose money by hiring an attorney, or you miss your window to sell in a good market.
