Your LPATM Lease includes a daily rental clause which has been used successfully many times to avoid costly evictions. Once a tenant defaults on their payments, and you are unsuccessful with calls and/or notices in getting payment, it becomes time for something little more drastic. The tenant agrees and authorizes you to have the right to have him removed and prosecuted in the event he fails to rectify his default situation as outlined in your Notice of Execution of Daily Rental. This notice has achieved results. The intended result is to get the rent paid ... or get possession of the premises quickly and avoid the lost time and expense of a full blown eviction. No tenant wants to face the possibility of arrest and removal from their home. So, we have had tenants panic, pack and split the same day as if they had the Police in hot pursuit! We have also had our tenants miraculously and suddenly come up with their arrears. Fortunately, this is not a form we use often, because our tenants, after being well screened and credit qualified, rarely get to the point of eviction. But- I don't have to tell you, sometimes things just don't go the way we expect. We need to have options like this available in case it becomes necessary to use them.
