We have been abused, threatened, and cussed out by our tenant. In our inexperience we made the mistake of trusting them she they seemed so kind. We have never been able to get a rental agreement with her because we cannot approach her. We made the mistake of raising the rent on them and they took us to the rent board. The outcome was that her rent was reduced to 533. 33 for a whole year. That caused a financial disaster for us since we could no longer cover the mortgage let alone anything else. Recently a gentleman offer to manage the duplex for us. We sent a letter to the tenants stating that we would be having our property manager handle the property for us and that he would be doing an inspection. I told them that they had stated in a letter to the rent board that they had implored us to discussed and set the terms of a new lease. I told them that since we had never done an initial inspection for a lease he would be taking care of it and gave her his phone number. I also sent a letter that stated that we would be checking out the broken window in her unit we had notice since last winter. After our property manager spoke to her he withdrew his offer to help us.I guess she bullied him too. She also sent us a letter stating that she did not grant us permission to enter their home. She claimed we had no legal right. This is the third time in two years she has denied us to enter her unit.By the way we have lived in the other unit of the duplex since January of this year. She often fights with her husband and is always slamming the door. I'm surprised the windows in the door haven't broken. Can anyone help me in this situation.

You have every right to enter to do inspections and repairs. Since your unclear on legalities and you are intimidated by her, you need to get a good landlord-tenant attorney to advise you and deal with her.

I can't begin to imagine what you are going through. I do not know what State you are leaving but all this sounds so surreal. Why don't you try to evict them? Because they are bullies you intend to let them get away with it? On one of those days or nights that you hear her fight with her husband call the police for domestic disturbance or something. AlsoIf she threat your life or even your property make a claim, go to the police. Is she a gang members that you scared for your life? more reasons to go to the cops.Do not let them bully you, because you are the one paying a mortgage, start an eviction process, get a good lawyer do something and STOP getting " financial wedgies" from bullies. For real? First of all, you don't state where you are from, laws vary by location. Who is the rent board? Are you in a rent control area? As long as you did not have tenant sign a fixed term lease, all you have to do is give them a notice to vacate, term would determin by your State law, wether it's a 15 day, 30 day, 45 or 60 day notice to vacate. No reason needed for that notice. You can check the landlord/tenant laws on this site at the right of the screen.

I'm curious to know what state this is. I don't know what a rent board is. Is this rent controlled, or section 8 (or neither)? Did you sign the lease with the tenant, or was this a lease that was already existing when you bought? You really should contact a lawyer and see if there is anything in your lease that you can find that will let you evict her.

If you know the landlord/tenant law for your state, your tenant won't be able to bully you with her lies. If you do not have a current lease then she is a M2M tenant and can be required to vacate the unit with a simple 30-day (or whatever time required by your state) notice to terminate tenancy -- no reason required. That's it! If she does not leave at the end of the notice period, you simply file for eviction in small claims court (or whichever court your state uses for FED) and out she goes! Quit being a doormat and take care of this situation NOW!

AND she does not have a legal right to refuse your entry into the unit with the proper 24-hour notice to inspect -- the inspection should be set for a reasoanble time and purpose -- for instace to inspect the condition of the property at or near 12:00 noon. She can only legally refuse entry if it is set for an unreasonable time or purpose -- "we'll be looking in at midnight to see if you're in your underwear."

24-hour Notice to Enter for inspection is not a request, it is a statement. Tenant need not be present. If she refuses your entry, call the police and get them to keep the peace while you do your lawful inspection.

You have to show this twit who's boss -- and BTW, that's YOU!

If you gave 60 day notice to vacate, no reason needed, then why can't you not accept her rent come the first of the month and file for eviction? If lawyer fees are that high, then learn the eviction proceedure, talk to other landlords in your area, go to court, sit in on some cases to learn what to expect and watch how the proceedings go. I don't know about any other landlord, but when I meet one here who doesn't know how to evict their tenant, I take them by the hand and help them get rid of their tenant fast. I would like to think any other landlord would do the same. Go to the filing clerk, pick up the forms you will need, visit your landlord associations, ask questions. Every landlord should know the laws and procedures to evict. Next time thoroughly screen all future tenants. Sounds like you've got a real nut on your hands. But I don't understand why the rent board and tenant friendly laws weigh so heavily against you. Sounds too exteme to be true.

Neither the landlord nor the tenant is the boss, and tenancy laws provide clear expectations about both parties'rights and responsibilities. As an owner/resident, I was instructed to leave after filing a complaint against an unruly tenant who attacked me twice while repairing damage to his lot caused by the absent landlord's ongoing neglect. Now I am stuck between unruly tenants and landlords who want to act like feudal scrooges. Tenants have rights, which landlords often violate as they forget that leases give tenants possession of their property for a period of time. To be honest, slumlords and slum mentality of some tenants causes properties to deteriorate rapidly as neither feel entitled to contribute to ongoing maintenance and repairs. Bring in agents who also don't care and a place becomes a cash cow instead of a home.
