I have a tenant whose lease will be up pretty soon. So she will be on a month by month plan. She will also be bringing in an additional occupant. So what I want to do is raise the rate to what's fair for two people. Or just raise the rate regardless. She's a problematic tenant by the way, in terms of late payment/lack of full payment. I wanted to raise the rate so that she would move. Apparently she's saying she won't be able to meet the terms. In response, I told her it was either this or she would have to find another place more viable for her. Then she said that the government would require me to relocate her. What?! Is this true?

You could always tell her to bring the information on that law in writing to you so you can pass it on to your lawyer (wink, wink).

If you want her to move, just man up and give her a notice to terminate tenancy.

If you want to raise the rent, provide her with the notice of change in rental terms and remind her in writing that remaining in the rental once the new terms take effect will oblige her to the terms, so if she "can't" pay the new rent, she must leave -- if she doesn't, serve the P/Q notice and evict.

There is no "relocation paid by LL" law anywhere, unless you have violated some law related to your rental, and then a judge would likely have to order it.

You can raise the rent but it will not solve your problem. Right now you have one problematic, late/partial payer. When you allow an additional occupant you will have two problematic, late/partial payers. These two will act like a magnet to draw in others. What you will need to do is to serve this tenant with a notice to vacate and hope to find a more suitable tenant. If you do not have it already, make it a part of your lease that others can not occupy your place during the lease. No landlord is required to relocate a tenant that has been terminated. You will not be required to do this.

Sounds like CA. Raise the rent in accordance with any rent control or rent stabilization laws. There is a limit to how much you can raise the rent and how much notice you must provide for each rent increase.

If you just want her out, look up the m2m termination laws. I thought payment for termination was only applicable to rent controlled areas. Are you in such an area?

You need to inform the tenant that you will not allow her to bring in an additional occupant, as you leased only to her. What government does she claim would require you to pay her relocation expenses? If she can't pay her rent on time or in full, how does she expect to pay a lawyer to sue you on this ridiculous claim, anyway. Tell her, simply, to get out.
