I think you have to wait until the appeal period is over. Your Court people can give you the answers as to waiting period, etc. Most Courts also have a FAQ section on their web sites that is helpful.

You will be able to get a lien on his personal residence and even garnish his wages. Landlords that are not professional really bug me.

Thanks Eric. Non-professional "professionals" bug me too -- I read a lot of your posts and think "Gee, I wish I had better luck with LLs" :)


I am not 100% sure on the waiting period. The court FAQ says appeals/vacates are rarely granted and are usually more money/time than its worth. Also, I'm not sure if the appeal period is in addition to the 30 day waiting period I have before I can contact the Sheriff. The judgment form only states the Sheriff writ of execution waiting period.

I'm reading a PDF provided by the court system and they said a defendant who does not appear may request the court to reopen the case, provided they have enough evidence. I can't think of any evidence he has to try to reopen a case he postponed then disappeared from, after declining any contact with us (confirmed via refused certified mail) and not trying to come after us for the rest of the lease term.
