Thanks for the clarification on the Privacy Act, I was working for a federal agency when I became aware of it. I never actually read it before, but had been led to believe that effected everybody, not just government agencies. BTW, it affects all government agencies, not just federal (I just read it).

If the company is paying the LL, then yes, they have a need for it. There is a (slight) chance that the LL is subject to backup withholding, which the company would be on the hook for. There is also a (very real) possibility that the company is legally required to issue the LL a 1099, which means that the company would need the LL's legal entity type, legal name, and identifying number to either issue the 1099 or determine that one is not needed.
