Do you ask the supermarket if they paid their Bread Bill before you take your groceries? (If you found out they didn't do you expect a refund for the food you ate?)

Are you getting to live there for the months you are paying for on your month to month tenancy?

If you were my tenant, and stopped paying rent, I'd ruin your credit and evict asap.

People are always pretty sure Walmart is not stealing the bread. If it gets to the point that Walmart is stealing the bread it would seem that people would stop buying it. The right thing to do is different from what can be legally gotten away with. Landlords in foreclosure are so quick to overlook this point while strumming about the tenant's moral obligation to pay rent while they are stiffing the bank.

To the original poster, FYI: the LEGAL OWNER would have to get a judgment against you before there would be any chance of anything going on your credit. No one can just, poof, stick something on your credit record. And the "ASAP" in "evict ASAP" takes a while.

And to Jack Klein, you would, of course, ask the landlord in foreclosure if they had been benefiting from rent payments during the time they had failed to pay the bank, right???

    Dear Anonymous,
    First of all, we are talking about a month to month tenant who is looking for a way to benefit from the financial circumstances the owner of the property is in. (Meaning he wants to live for free because the owner isn't paying the mortgage.)

    You may not realize it that leases do remain binding after the sale of the property and in most cases survive bank foreclosure. That is when the payments are made to the bank or new owner or they will commence eviction.

    All that is needed here to terminate a month to month tenancy is a simple 30 day notice.

    If the owner benefits from receiving rent and the tenant gets what he is paying for, what is your problem?

    The only problem I see is a feeling some people have that the tenant has a right to stop paying for a service he is receiving according to his agreement.

    ( I used the bread analogy to simplify it for people who don't get it)

      like i said im not bound to any contract my lease clearly states that after the first year feb 2011 my lease ended i was then supposed to re sign a new lease for month to month payments in turn paying him 75 more dollars... before my lease was even up he quit paying the mortgage and told me... i said im moving out then, he lowered my rent... the problem i see is my service (the house) is going to randomly be taken from me (of course i get a 90 notice to leave from the bank) my worry is im going to pay him tomorrow and then the next day be evicted by the bank. I guess i need to find out if the bank owns it or not or something. thank you all for your help
