I would advise you to not apply much logic to your landlord. Yeah, logically, if he can't pay the mortgage, you'd think he wouldn't fork over the money to try to evict. But you never know. My former landlord took me to court for refusing to pay for utilities he was stealing (He lost, by the way). Some people are stupid.

I'd base my decision vis a vis the rent checks on A) who the legal owner of the property is (if it's a bank, don't send "rent" checks to someone else) and B) when you will find a new place and move out on your own.

Of course, you can always hazard a guess as to what your landlord would do if he stopped receiving rent checks. Again, knowing when you're vacating would likely help you make a decision. If the landlord knows that, on March or April 1st, you're moving out of the place he's going to lose anyway, then you might be comfortable using the remaining rent money to pay the movers.

Does this landlord have a security deposit??? If you vacate before he returns that, you can expect to never get it back. Even with a judgment, this guy sounds really bad with money, and his credit is already ruined, so he's unlikely to pay any judgment. But just so ya know, in all the states I know of, failure to return a sec. dep. means the tenant can sue for double (sometimes triple)the full deposit. If you haven't already done so, read up on the sec. dep. laws. They're always easy to find online and are very clear cut.
