Thanks for your replies. The mistake was realized about 10 days after the original notice was sent out or 10 days into the last month. Then the tenant stalled and said "let me check with my roommates to see if they will pay" and delayed several days. by that time it was close to the end of the last lease month (about a week out from the end of the month). While the tenant was "checking with roommates to see if they will pay their part" I sent another email reiterating my mistake and that payment was due. Then the tenant replied "no we will not be paying you rent for October". So we were out the rent for the month, plus now the condition the property was left in was damaged & filthy and the T is refusing to pay the amount of cost to repair and clean the place above the security deposit.

So I'm glad to know that I might have a good fighting chance in court, as the T is so cocky and says "my attorney has advised you have no case (T apparently works for a law firm, not a lawyer or paralegal- nothing legal- janitor for all I know) and I will take your money in court". Oh well, off to fight the good fight I go- thanks again.

Oh by the way- when I communicated my error on the 10/10 I did tell T that there are two options: 1) Pay rent in full and stay till the 31st, 2) don't pay rent and vacate by 10/15. T then came back after 10/15 and said nope not paying and not leaving until the 31st.
